hi i posted on here back in july when my dog got into a fight with a spaniel and we were reported. just thought i'd update. still going. he tried to get us and my mum charged on the dda 1991 section 3 but there was not enough evidence apparantly so now he wants my husband done under the dogs act 1871 section 2. what he wants to gain out of this i do not know as our dog is ALWAYS on a lead when out. but anyway, just to let the nice people on this forum that gave me the support i needed how things are going. we are due for the hearing on the 28th of this month. our dog is blissfully unaware of the trouble he's caused!

Some people just get off on being bastards and causing trouble. Sadly Plod is always happy to help such people out.

Refresh my memory - was that the little kid taking the spaniel out and your little one went outside when your mum went to the loo and your dog got out and attacked the spaniel?

The owner of the spaniel (who is a total plank for letting a young kid out unsupervised with a dog) is an ex copper or something?

How am I doing?

If I'm right - I didn't realise that prat of a man had kept this thing going. And I don't understand why it's getting taken so far when it was a dog on dog fight - no humans involved. And why is the tosser that let the kid out unsupervised getting away scot free?

Do you have a solicitor on the case? What's he saying about it?

A dog should be under the control of a fit and proper person - so sad plank who is giving you grief is just as guilty for letting his dog out with a kid.

And if I've got the wrong case, then I'm gonna look really silly for ranting about something totally irrelevant!!! Loughing

I hope you get on OK with this. Will you pop back regularly and let us know how you go?

yes thats the case, you got the right one! think the only reason its got this far is that the bloke is a copper. he really is pulling out all the stops. trying not to get upset over it anymore, more angry now than anything! our solicitor has been really good, unlike our insurance , tesco's! they won't even give us legal representation! third party liability does'nt count for alot it seems. it would be better for us if our dog had actually killed someone as it seems for that, we are covered!! anyway, will keep you posted.

I hope your solicitor can get this sorted out. I think it's an utter piece of crap. And definitely a case of not what you know but who you know.

A bloke up the road from us had a German Shepherd -never on a lead and it used to put the fear of God into my mum because it would run at her growling, crouch down, ready to pounce, growling all the while. Cops said that they couldn't do anything unless it savaged her! What happened to the dangerously out of control there?

I really can't believe this whole situation and I hope you do get it sorted out in your favour. I'm livid on your behalf (wish I knew where the prat lived - I'd come and sort 'im out for you!)
